I was working Tuesday morning on the massive amount of receiving we were getting in from IPCPR show and I see a car pull into the parking lot. I notice the front plates are from a division of public service (cop style plates). The door opens on the car and it reads "Department of Heath". They come in and tell me that they are with the health department. I asked if someone had complained about us, they told me "no this is just a routine inspection". Now I've worked for the Outlaw for almost 10 years and I have never seen the health department for a"routine inspection"! No one was smoking when they came in. They walked into the lounge and noticed all the dirty ashtrays. At this point one of inspectors makes a comment about all the butts. Kendall(who has returned to his seat) tells them that they were ashtrays that we use outside since we can't smoke in the store. The inspectors return up front and say that there are too many dirty ashtrays for that to be true. One of them starts talking all tough and official like to me. "Well, we could write you a ticket because it's obvious that you are allowing people to smoke in here, but I'm just going to write you a warning...". I'm looking back at Kendall who is shuffling through his notebook trying to find a piece of paper. As this jackass is braying at me about the ordinance, Kendall tells the guys that he has a copy of a letter from his lawyer that says that we are exempt according to a Missouri statuette that overrides the cities ordinance. So they go over and start talking to him and they get into a long winded conversation about the law and finally the health inspector tells him that he needs to make a phone call about this. So they both go back outside and they make the call. Kendall goes outside and they start talking to him again and the one guy starts writing up something. I can't hear any of this talking. The guy gives Kendall a piece of paper and they get in there car and leave. Kendall tells me that they were just going to give us a warning but he told them to go ahead and write the ticket so we could get the ball rolling.
Well as soon as they are gone he is on the phone with his lawyer. He asks the lawyer if he should continue to allow people to smoke in the store. The lawyer tells him no. The reason is because we will go before a judge with this ticket and it's always better to only have one ticket not twenty. In the eyes of a judge, if you have a fist full of tickets, you have no respect for the law! Quickly we gather up things to make a smoking area outside. We are scheduled to go to court on the 25th.
Now this is death for me because the store is the only place is smoke. I work 10hrs on the days I work so when I go home I go to bed. When I'm off I have three children and the wife so I don't smoke around them. I try not to smoke in my vehicle. The Outlaw was it. I smoke them when I work. The outside lounge doesn't work for me because I can't do my job outside so for lack of a better term I'm fucked! Who wants to buy some cigars!?!(just kidding)
The store is now weird to come into. We have turned off the large air cleaners so it's very quite. The background noise is all different. The smell, the wonderful smell is gone. I'm so acute to the changes that I can smell if some drops an air biscuit in the other room. Of course I'm half crazy from the lack of smoke.
Hopefully everything will go in our favor and we will get our lounge back. Events will go on as usual, just no smoking in the store. I remain optimistic about the whole situation.
 
Sorry to hear this Brad because I am sure when clients go to a cigar shop they expect to share some conversation over a stick or two. It's like serving alcohol but not allowing anyone to drink it at the bar.............so, they go home.

Perhaps it's time, pending your court decision, to start charging a nominal fee for membership and becoming a private club? Would that work?
 
That is indeed disturbing. It would be interesting to see who supported that law/agenda with time or money.
Trampling on freedoms for profit, votes, neurosis, etc. is becoming a bit too prevalent in todays world.
This is exactly why I am supporting certain entities who work to battle this nonsense. Tobacco enthusiasts have all become targets. I don't like being a target.
 
I am so sorry to hear about this Brad. I hope the outcome is favorable for the Outlaw on the 25th.
 
Welcome to the police state.

You MAY be able to open a separate, private smoking lounge - members only! Do not employ anyone at the lounge, though. And look into a "grandfather" clause.

The brownshirts are getting more powerful every day! If we don't act together they'll divide and conquer. Works every time.
 
Sorry bout the bad news brother, sad to see outsiders coming into a peacefull place were people can come together to enjoy a smoke and harass (spl). I don't often smoke at my local shop but when want to I would hate for me not to have that right.

Apparently, the whole purpose of these bans is to protect employees from the 'danger' of second hand smoke. That is the strongest of their arguments, and it is a weak one at that.

Clearly, with specialist stores like the Outlaw, there are not going to be employees that are going to complain about tobacco smoke, as they smoke themselves. If there cannot be exceptions to the rule that permits places like this from allowing smoking indoors; The authorities will have crossed the line from 'protecting' the working man to punishing them.

Do not make the mistake of thinking that the policing and micromanagement of our lives will stop with smoking either. The crosshairs are once again aimed at alcohol, as well as fatty foods at the present. I predict caffeine will not be safe for much longer too, if this farce continues.

Funny thing is: Cigar sales increased last year, despite the ban. Clearly their assault is not working, and will never work as long as people like us grab hold of our freedom to choose and don't let go no matter what. I say we go further than that and demand concessions to this fascist restriction on the consumption of a legal product.
 
That's horrible. Creating smoking bans for cigar shops/lounges sure is ironic... We're moving down a road that makes no sense - I just hope people start getting smart... There are so many laws these days that simply don't make sense.

I hope everything works out for you guys. I'm on the west coast, and almost every herf I go to, big or small, the Outlaw always comes up! Best of luck you...
 
I'm hoping that as funds allow, we'll see more shops with segregated smoking rooms. Non smokers forbidden entry.
 
Brad, I hate to hear this. Although I'm not really one of the regulars like the guys you mentioned, I still enjoy coming in and enjoying a cigar in the lounge on occassion. For as great as your store is as far as selection, and the events, the best part is the interaction with you guys that work there, and the regulars. I hope the court case works out in your favor, and in the meantime try not to kill anyone since I know you will be on edge without your cigars. :laugh:
 
Sorry to hear about this Brad. Everyone here knows The Outlaw and the contributions you've made to cigar smokers everywhere. Hopefully, the ruling will be in your favor. We're all pulling for you, buddy.
 
I am young and I should know everything but this ridiculousness is far beyond my comprehension.
At what point did the average citizen become too stupid to make a decision for himself?

I wish The Outlaw all the best in the upcoming proceedings.

I've only been through your neck of the woods once and I didn't have enough time to drop by... shame too, because the Outlaw has always looked like a great time. Good luck-- I really hope you guys can stick it to these needle-d!cked bureaucrats and bring smoking back to the shop.

That's horrible news Brad. You guys have one of the finest establishments I've had the pleasure of visiting. It was a fabulous place to sit and enjoy a smoke.

I hope this works out for the better.
 
you cant smoke in a cigar store,but you can buy crack on any street corner in any big city.

I'm really sorry for your loss. It is truly unbelievable that they can ban something like that. No one in their right mind would go into The Outlaw, unless they were specificially looking for cigars/tobacco. Wow, ridic.

Anyways, that really horribly sucks smoky, hopefully you get a judge that isn't planning on running for office soon, and who doesn't have their head up their butt. Good luck to you guys.
 
Fight them hard. Challenge the constitutionality. Threaten further action based upon constitutional violations. Be ready to file appeals. Be ready to look for each and every loophole.

These fights are everywhere and we certainly have them here...sad.
