Apartment complex won't let enlistee out of his lease

ST. PETERSBURG — Mike Agosta enlisted in the Army and learned he would ship out 19 days later. He expected his apartment complex would let him go without penalty, considering he was ending the lease to serve his country.

He was wrong.

Florida law allows military personnel to break their leases if they show documentation and give 30 days' notice. His apartment complex, Camden Lakes, said it wouldn't accept his request to end the lease.

"I was really dumbfounded," Agosta said from his father's home in South Florida, where he's visiting before shipping out to Fort Jackson, S.C., on Tuesday.

The company that owns the complex at 11150 Fourth St. N said it needed his official orders, which he says he won't receive until the first day of boot camp. Agosta said he showed his signed Army contract, but the company wouldn't accept it.

It's unclear what penalties Agosta might face for breaking his lease. Ed Malone, regional vice president for Camden, wouldn't discuss Agosta's case, but he said the company's leases follow state and federal laws dealing with military enlistees.

He said the company has no discretion in allowing some people out of their leases because that would be unfair to other tenants.

Not so, says a Palm Harbor lawyer who took up Agosta's case pro bono.

Upset by Agosta's story, Justin Zinzow filed a lawsuit for him Tuesday. He said the whole agreement should be thrown out because the lease violates a Florida law allowing military enlistees special privileges. He said fair housing laws — which prohibit race, sex and other types of discrimination — don't bar Camden from using its discretion.

Agosta could give notice later and accept about a month's extra rent, but he said he felt like the complex was insulting him by doubting that he was enlisting. He also doesn't want other recruits to face the same hassles.

"Good for him. He's truly a patriotic American," Zinzow said.

Agosta grew up in South Florida but moved to the Tampa area with a DJ business so he could travel the state more easily. He worked for Verizon as a cable splicer for a few years. Recently unemployed, he decided to join the Army.

Sgt. 1st Class James Butler, an Army recruiter, said Agosta's experience was unusual.

"Normally, most apartment complexes or homes are pretty lenient on it," Butler said. "This is the first time in seven years since I've been recruiting that I've had an issue."

That pisses me off too bad its not 1995 or else i would plug my computer into my extra phone line and run a war dialer to call wait for an answer and hang over and over for a few days straight just to clog the lines. ESP the corporate office. I have a few friends thatin iraq and one who has layed down his life for it. Anyone who is willing to go should not deserve something like this. If your against the war your against the war but dont ever be against the troops. Any new recruit helps het out thoes who have been their for more then their fair share. So just joining up right now is really more help for the troops than it is for the war. The lad very likely has a legit out to his lease. However, I understand how the apartment owner can be cautious. If everyone were honest, verification wouldn't be an issue.
 
I'm a Vet and a 3rd generation landlord. I wouldn't trust a tenant as far as I could throw him. I, of course would let the fellow out of his lease, but I would demand proof.

Having been a landlord before myself, I would agree. I'd let the guy out of his lease as well, upon proof. This should be easy enough for the fella to offer up.

I was a Landlord for two years and It was about 2 yrs too long! I would want proof too, but would whole heartedly let him out of his lease if he showed me his signup docs!
 
I am not a landlord nor have I been so is the signed enlistment paper enough proof or is it too easily forged to be accepted in this case? And, if not after he talked to to manager with this paper shows she tried asap and if he gives them his official papers later I would think the lease should have stopped the day he showed the first paper, no? I would let it go if I was the landlord but some of you here are more educated in the process. My first post was an emotional angry post. But after hearing all you current and ex landlords saying that the tenants lie a lot about this sort of stuff (I guess I was a good tenant when I lived in an apartment. Cause I never had a problem. (Until the price hike in the 3rd lease was too much for me. After being a good tenant for a year I left. Although only after finishing my last lease just not signing a new one.) So IDK but I certainly think it will all be reserved and the lease will be canceled as of the day he showed the enlistment papers. Since he has a lawyer at least. Although this is just what i think not knowing anything about being a lawyer or a landlord LOL so i have not real clue.
