Cohiba Nightmare!

Ok so I was working one night last week, and I pulled a car over because they didn't have any tail lights. There were 2 guys in the front seat of the car, and you could smell the marijuana coming out of the car before I even got to the window. (I almost forgot about the weed..) They looked at me like I was a complete idiot for a minute, until I regained my composure then I remembered to lock them up for the weed. It irritated me for the rest of the night. Anyway I thought I would share that with you guys. Tell me I didn't over react, and I made to big of a deal out of it.

So if I keep good smokes in my car at all times, it stands to reason that I can be let off with a warning? :whistling:

Come on over to Puff N Stuff sometime. Al's got plenty of good smokes and tons of good advice when it comes to this hobby of ours.

I still love the jailhouse lawyers given their "clients" advice on what to do and not do with police....

i.e. - "say 'no' to any search of your vehicle, if the officer asks!" That, in my mind, meant I just had to jump through one more hoop before my search. Seems such a shame to be more understanding of the bad guys situation after all of that hoop jumping he just made me go through. :D

I still love the bad guys talking about "probable cause" like its some kind of guaranteed protection. If the public REALLY knew how thin "probable cause" was, it unlikely they would ever do anything wrong.

And if you think you're protected because an officer has to get a "search warrant". I used to love to doing search warrants because it gave me even a ton more latitude than a simple street search. :laugh:

Bottom line, boys and girls - take Q_the_Cop's wise advice - don't try to do bad things in a car driving around in public. Especially when you're going to destroy a good cigar to hide your nonsense. It's likely to get you arrested... ;)

That is the Constitution, brother... Also close scrutiny by legislative bodies, as well as our court system.

Sometimes people confuse being able to get away with murder under the cloak of Consitutional protections - vs. what the law truly says and was intended to do... :rolleyes:

Probable cause does exist for that, but unfortunately "proof beyond a reasonable doubt" might be an issue here... :cool:

Ditto, I am worried. Probable cause is a fourth amendment right that is meant to protect us from meaningless, unwarranted prosecution. Our rights being regarded as another "hoop" that you have to jump through pains me. On another note, how could've you actually "love to do search warrants" because the extra latitude it gives you? The way that you've phrased this comment, and the aforementioned one, makes you sound like a petty tyrant.

Maybe there is something that I am missing. Maybe I am a young, naive idealist. Maybe I am ignorant of what it takes to protect me in this scary, scary world of ours. Maybe but, then again, maybe not.

Rod, I invite you to squash this conversation if it too closely borders on politics.

So I take it by your post you have a problem locking up those that deserved to be there? And even more disturbing that you would think it unthinkable an officer would enjoy doing what he was sworn to do - uphold the law? Well now - that's interesting...

From my perspective - if you don't break the law - you have no worries. If you do - don't expect the Constitution to provide a shield from what you have coming!!! It was never written into the Constitution to escape searches and seizures by law enforcement - just "unreasonable" searches and seizures. Huge difference...

Based upon what Q_the_Cop said in his post - I think the courts would rule that he had sufficient probable cause for a search, and uphold any evidence of the suspected drug crime found during the course of that search. It really does suck to be the guy who's smoking dope in a car on a public way - risking other persons in the public way with his careless behavior - but maybe he'll think twice about doing it again!!!

...and if it is true you weren't intent to fire up a political debate on the issue, maybe you should have carefully thought about what you were posting instead of pulling Rod into the issue after throwing your .02 out there. That's awfully ignorant and naive as well... ;)

Nahhh,,,you did the right thing with these assclowns. Chances are had they apologized to you about what they did with making their blunt out of such a great cigar you "might" just look past the weed incident,,,NOT! I've seen worse incidents in regards to cigars as when I gave my brother an Opus X cigar. Told him all of the virtues of this fine cigar and how expensive they were,,,etc etc. He lights it up and smokes about an inch of it and then crushes it out in a nearby ashtray saying it was too strong for him. I nearly went ballistic and have never offerred that asshat another stogie since.
 
You won't find too many BOTLs going on and on about NC Cohiba cigars. What you are more likely to find are many BOTLs regarding NC Cohibas as being overpriced and similar to Graycliffs (not worth the price).

Only problem I see with this scenario is as follows: Driving Under the Influence. That gets people hurt, kids killed, families torn to shreds.

Otherwise, who gives a shit if someone is smoking 'marijuana' (not dope) wrapped in NC Cohiba tobacco leaves. In fact, I'd like to read the review.

I had an "afficionado" do the same exact thing with an ISOM Monte #2. Said it was not the ISOM Monte #2 he had come to know - undoubtedly he'd been smoking fakes he'd be relishing as the real thing.. I coulda killed him!!! :rolleyes:

More or less, without trying to insult ya...most people don't know and don't wanna know what happens in the dark-cornered edges of society, far away from the comforts of their everyday life. People want the thieves and the murderers, rapists and child-molesters, to stay far far away from them and their families...which is absolutely more than reasonable. But, in the same breath, they also want to make assumptions and criticize how the Law is enforced in this country.


The Constitution protects you from "unreasonable" searches and siezures. Looking at procuring a search warrant as another "hoop" to jump through should not "pain" you. It should make you appreciate the fact that the Officer in charge of the investigation is making sure he/she covers all of their bases, following the protocols in place that prevent your rights from being violated. It should "pain" you if an Officer neglects to obtain a search warrant, and just barges through, violating your privacy and subjecting you to an unreasonable search.

Get a little more experience in the way the world works, and appreciate the fact that people sleep peaceably in their beds at night only because rough menand women stand ready to do violence on your behalf.

That's all I am gonna say in this matter.

Wow, this post did take an odd turn. Too bad I was out of town or I might have contributed a bit more! I think the law enforcement folks have made a good point...my original point was only to point out that these guys were not mental heavyweights.

I know what you mean. I was just telling a story about ignorance. Thats all. I didn't want it to turn that far south, and turn it into a law argument. By the way I'm also a DRE (DRUG impairment RECOGNITION EXPERT) so he did get a dui drugs. Should have given him a disorderly conduct for the Cohiba. :laugh:

Gentlemen,

From the responses that I've read, I notice that there are certain misconceptions about the post I made. I also realize that a cigar board may not be the best place to hash out ideological differences and the typed word may not be able to convey all the sentiment meant to be conveyed. This conversation could turn into a very long one, indeed.

I invite the both of you, ggiese & souldog42ca, to come have a cigar with me one day so that we can talk about this matter more. If we still disagree, then we will at least be able to agree that we are smoking some damn fine cigars.

If you feel like we need to carry on, please feel free to PM me. Oh, I really appreciate being called naive and ignorant. Being insulted is why I get up every morning. Peace.
