Problem with an Ebay auction

I have a thread in the wine room about Wine Fridges. Here. For those that do not want to read about wine and wine storage here is the deal. The seller posts an auction for a wine fridge. It is purchased via the Buy It Now option. I missed this auction by a few hours. The seller has a history of selling these and so I write the seller and ask if she has any more. She does and posts a new auction right away. I purchase this and pay using PP. Three weeks later, I have heard nothing and have no wine fridge. I have sent at least a dozen emails to the seller, all very kind, asking for a refund or the fridge. No response. I have taken it to PP and tried to fix the problem with their "discussion." No response. I have turned the matter over to PP and and they will now choose a "winner." This is obviously going to be me, but, I spent $325 on the thing and I will only be able to get back $200 minus their fee of $25 for a total return of $175. WOW!
If anyone has any input on other ways to get all or more of my money back I would really like to hear them. This is just ticking me of to no end. I do not think I will ever be using their service again as it is obviously not worth crap. I am more than willing to provide all the info I can to those that know anything about this process. Thanks in advance.

Sorry to hear about that schwiering. Did you use a Credit card through paypal or bank acct? You might be able to contact both and ask them to refund the full amount and forget p@yp@l. I made a purchase through PP once with a credit card, received nothing and contacted my credit card company and they issued a full credit to my card. Even though it was a smaller amount ($50), my credit card company was very helpful on this. I just had to provide proof of the scam. PP was no help at all. Hope it works out for you.

Sounds like the seller is a drop shipper - the product is not something he/she has on hand, they order it through a distributor and the distributor ships directly to you. Problems happen when the seller makes a sale , but the distributor is out of stock.

I would continue to try to contact the seller in a polite and businees like way - that is your best option to get the product, or hopefully a full refund.

The Paypal mediation is a necessary evil to protect your interest and it may light a fire under the seller's ass. Was payment made via Paypal on a credit card? If so, you can work directly with your credit card company to get a full refund.

You can't double dip. They will not allow you to submit a claim with them if you have already submitted a claim with PP. If someone can show me how to submit a claim with Ebay I would be grateful. I have yet figure that out for myself. One would think it would be easy.

Click on "My Ebay" then on the left side, down near the bottom "Dispute Console." You should be able to go from there.

Sadly, no. They drafted the funds from my bank. I plan on contacting them about it tomorrow.

Sounds like the seller is a drop shipper
If this was the case then why wouldn't they just respond to my emails and tell me so?

It also turns out that I am not the only buyer that is having this problem as of late. The seller had 2 neutrals and 1 negative posted against them today alone. Those sales were from early December.

I guess it varies on credit card companies because I remember doing both, claiming with paypal and contacting the CC and once the credit was issued to my card I just contacted PP and closed the claim with them while they sat on there @sses. ???

If that's the case, it's very possible they're just wrapping up their business, taking whatever they can, and leaving. If you start seeing the negatives pile up over the next day or so, that's the case. Happened to me once, but on a smaller purchase, so I was able to get everything back.

I had this happen with a much larger sum of money. Ebay claims this rarely happens but, I'm seeing more and more of this. First, that is ebay's policy on reimbursement you quoted there. PP has a much better policy. Of which I believe they'll cover up to 1K. I empathize with you and most certainly know how you feel. Tha bad taste in my mouth has yet to go away. Good luck in your recovery.

I wish this were the case. The ebayer has to have 50 possitive feedbacks, 98% of them possitive, have a verified bank account and an upgraded account (whatever that is) to have that 1K coverage. If not, and this is one of those, then PP will only cover $200. PayPal is owned by Ebay so their policies are pretty much the same.

This really sucks!!!! They should cover us 100%. Afterall we are going on all of their info. This just pisses me off even more.

I have complaints in at the state and federal level. Hopefully, one day. I'll be notified. Shit my pants and find out they're not after me. :D

paypal and ebay is nothing but a license to steal. paypal can pretty much take your money without any warning.

If this is the case, as I presume it is, then why not just take the money back and give it to me? I really never understood people who didn't use Pay Pal. Now, I understand why they would not choose to use such a terrible service.

I could be totally off base here, but once you file a complaint with PP they freeze the offenders account. If you suspect fraud which I think your saying, call your bank, then lodge a complaint with the Feds.. Ebay isn't going to help you they are more of a arbitration system then getting you a refund. Your best bet is to follow through with PP IMHO.
