out of missouri, botl on another board just recently bought a box of cigars from this vendor, a couple of months later he recieved a letter from n,j, for 30% of cigar costs. the tax is $72. guess new jersey is putting pressure on out of state vendors. ???
 
I have been to the Top Hat B&M store. The humidor is very small and only about 1/2 filled. Did they have something special at a good price, because I thought all of the cigars in the store were about 15-20% overpriced.
 
Greetings! The only items that I have ever purchased from Top Hat Cigars were two nice cigar cutters which were reasonably priced. Yes, some of the states are cracking down on tobacco taxes. This is very unfair. All tobacco purchases made on the Internet, by mailorder, and by telephone should be exempt from any and all taxes, in my opinion. Some of the archaic tobacco regulations need to be taken off the books. Regards, knightlaird
 
That's crap! I can't believe this type of behavior. They might as well slit the vendor's throat. It is going to make it really hard for vendors in N.J. to sell product out of state, which is how a lot of us buy our cigars in bulk.
 
the way i see it, the only alternative is the dark side. i don't think those vendors will rat you out. this vendor should be avoided, imho! :cool:

This is just another good example of the theives that we have in the system. They are like all the banks, nothing but a bunch of theives.
 
You think this is bad? Here in NH we have cheap tobacco and ETOH. Mass and Maine State troopers were patroling the parking lots of our state stores, writing down the reg. tag nos. of their respecvive residents,then arresting them when they got home. Needless to say, Our NH troopers ran the sob's off. Live Free or Die!!!

sigh, that is total crap, and they cant figure out why small businesses are going under and people don’t want to open them anymore. Gee I wonder...

If that's true, man does that suck. Behavior like that seems almost Gestapo like. Good for those Staties that ran em off.

Though it does remind me of Smokey and the Bandit.
 
The store is the one to blame in this situation. They have no business contacting the state of NJ and telling them this person bought cigars. They are assholes for doing it and should be avoided at all costs.
 
I just got back from a visit to my B$M. From what I hear there, your're going to see a whole lot more of this. There seems to be a movement to curtail interstate tobacco sales.

In defense of this action, all states that have an excise tax, require retailers to include (in duplicate) all invoices for out of state sales because the retailer
is not required to pay the excise tax on these cigars. You the consumer are responsible for excise and sales tax in your respective state. So if you think he is the only retailer doing this, you are mistaken. Nebraska sent out over 6000 tax bills for online tobacco purchases recently, Wisconsin over 5000. This is according to the RTDA publication. As for hurting small business, it couldn't be any further from the truth. States collecting excise for online sales will level the playing field for your local B&M. I have to add 30% to the cost of cigars due to Georgia's 23% excise tax and 7% sales tax.

What happens if the vendor is including the excise tax in the purchase price? I wonder if that would be an adequete work around. Since excise is so haphazard in terms of tobacco.
 
Fine if they want to tax tobacco, but it needs to be in the price of the goods and not a bill a year later. Seems like some states maybe trying to cut the shops a deal, but IMHO it smells of funk.

Thank God I live in Texas, if even the most liberal part of the state. But than again we have our own huge set of problems in this state.
 
Overall the situation stinks, and I think most of the anti-smoking shipping BS is really about this issue and not minors getting ahold of smokes via the internet. I guess it is just another attack on smokers again.

Totally agree here.

This is absolutely insane and will lead to all kinds of logistical problems as far as proof of sale and the exact nature of products purchased. Is the state of NJ going to go to this man's house and physically search his humidor and demand proof of all purchases and taxes paid on those purchases or are they just going to take an out of state vendor's word for it? Are cigar smokers in NJ required to keep all receipts from in state purchases to prove they paid the taxes? What the hell is going on here?!!

The costs of enforcing this nonsense will quickly outweigh the monetary collections by the state.

One more step in the "criminalization" of a completely legal product.
 
I just heard Saturday that Indiana is contacting out of state tobacco vendors and going back three years!

I think I am safe except for c-bid and CI. As an auction site I wonder if they can collect my c-bid purchases.
