I have a question (or two) that I’ve been unable to find any information on. If it is out there, I apologize for the duplicate post.

Person A ships cigars to person B via PO w/DC. DC shows package delivered, however delivered to wrong addy. Weeks go by and no smokes, claim is filed with PO, however they are not willing to re-imburse due to no insurance (not sure if ins would cover cigars anyway?). Regardless, neither party did anything wrong, smokes are just gone.

Would person A have to eat the loss? Would person B? Should the cost be shared?
 
just my opinion, but if I were person A - I'd send the cigars again and make sure they arrive as best I could.

edit to add I'd do it even if person B insisted on sharing the cost/saying forget it

I know when I sold on Ebay (So this would go for a purchase) that if Person B elected not to get insurance on the item then it would be their problem. I never forced them too but I never had a package lost either.

It would all depend on the relationship between person A and B also.
 
There is no right and wrong on this. I have had only one package never show up. But, I would mutually come up with a solution that works out for both of you. Maybe you could split the difference and the other person could pay the postage, just an idea.

I agree with Anthony in that something can be worked out when it's BOTL involved. However, I do believe the onus is on the shipper to ensure you receive your goods. We ship out over 200 packages a day, majority with USPS, at least 1% never gets to the destination, we have no option but to re-ship. We know that there are customers that are not truthful, nevertheless, if we cannot prove that they received the package, we have to re-ship.

One thing I have learned (the hard way) is to ship UPS or Fedex when the value exceeds $200 or thereabouts. Rather pay an extra $10 now, than $200 later.

If this were a sale or trade:

I would contact person B and try to work out a solution were I person A. If I were person B, I'd do the same. If that's an impossibility then one of the parties is likely being unreasonable. There's always something that can be doen to work things out.

If it was a gift or or something like that, I would just resend a comparable gift if I could. If I were person B in that scenario I would thank the BOTL for the thought and tell him not to worry about it if I knew about it.

That's just me though.
 
It may take a while, but if there was a valid return address, you should see them again though that's not guaranteed. If it were me, I would re-send especially if it's a purchase that's already been paid.
