Calling out Chris28054 - What to do?

I've been running my scotch buys here for over 5 years and have never had an problem until now.

Back on 12/05/09 Chris wanted to know if I could get him two bottles. Since they were hard to get and had some long lead times I told him I would order them but he would have to make a 50% down payment.

On 01/18/10 I told Chris the bottle were on hold and now is the time I wanted the down payment, He said it would be mailed the next day.

On 01/28/10 I told Chris nothing had arrived as of yet

On 01/29/10 Chris said he sent the check late

On 02/01/10 Check arrived

On 03/06/10 I told Chris that his bottles would be in within the week and that he has to pay the remaining amount due. He replied it would be in the mail the next Monday

On 03/12/10 I sent out a reminder about payment that hasn't been read as of the time of this post.

On 03/22/10 I sent out an email saying he would forfeit his down payment if he didn't contact me

No contact has been made and he has not logged on since 03/10/10.

My questions to the esteemed members of CP are this:

1.) Do I keep his money and eat the remaining cost of his items?

2.) Do I keep the money and try to sell the items at the asking price making something for my aggravation?

3.} Do I keep the money and try to sell the items at a discount thereby breaking even?

4.) Do I return the down payment and eat the cost of this whole fiasco?

I say keep his money on hold and try and sell what was ordered after he returns or if he does then find out what happened and deal with it in a gentleman manner
 
First Ray, sorry this happenned!

I would see if anyone has his phone # (if you don't have it already).
If there is no response to phone calls then I say do whatever you want!

If you really want to cover all bases send a certified letter.

Sorry to hear about his situation Ray. I definitely don't think you should be stuck with the cost of the bottles. I think any of the other options would be appropriate. After a certain amount of time has passed with no contact you have the right to consider his down payment forfeited. It's not as if you have not been trying to get in touch with him.
 
Something tells me you wouldn't have that hard of a time selling the bottles. I would put them up for sale at no discount. When you sell them, send back his money. Add him to the scum bag list and go on about your merry way! That way you're not out anything and you are the better man.

As golden as your reputation is AVB, you should do what you feel is appropriate, you know better than anyone what action you should take.
 
I would say option #5 (what Doc and Smokyballs suggested) is the best option.

BTW - What are the bottles that were ordered?

It is a genuine pain in the ass, but sometimes we all get the short end of the shitstick. Banning and Scumbag List are about as severe a punishment that can be meted out when it comes to something like this.

If you gave him fair warning...then move along and sell the product.
Keep his deposit unless he otherwise has a really really good verifiable explanation(the last part is my opinion).

I disagree. Banning, Scumbag list and keeping his money is more severe.

Banning and Scumbag List are about as severe a punishment that can be meted out when it comes to something like this.

I agree completely. Only I would take out a minimal fee for your time having to go to the bank, etc., and postage cost when you send back his funds.
 
Hey Ray, Sorry to hear you got handed this mess. Just thought I would also throw my vote for option #5. I have a trip to KC coming up, and if I remember right several of those guys have a drinking issues :) maybe a bottle or two could fit in the plans.

I will say this and it will be something to ponder on. I was scheduled to see my best friend last year before I had my 11th surgery. We was going to spend a few days chilling together. I talked to him on Wed night and I got the phone call he passed away in his sleep the next day. If his family wouldn't have called me, I may not have known what happened to him. You never know. Before you start a lynch mob, you may want to learn all the facts.

I wrote Ray on several points and I think he will agree with them. I would hate to see Ray get burned, but we simply do not know all the facts yet. And I'm, sure he could get
someone to buy the bottles in question. Depending on what they are.
 
Sorry to hear you have been put in this situation.

I would put the bottles up for sale for your cost, if they sell, donate his deposit to the forum and call it an asshat's contribution for being a pain.
