Smoking at my cigar shop now ILLEGAL

I think this is where my member title comes into play. " MOΛΩN ΛABE" as defined in Wikipedia.

The Greek phrase Molōn labe! (Μολὼν λαβέ; approximate Classical Greek pronunciation [moˈloːn laˈbe], Modern Greek [moˈlon laˈve]), meaning "Come [and] take [them]!", is a classical expression of defiance reported by Plutarch, roughly corresponding to the modern equivalent English phrase "over my dead body".
 
So far this is what I know. The ban has been passed. It will be 60 days before it goes into effect. The fines that are and will be leveed against us will be taken care of by the Outlaw until a time that it is no longer feasible for us to do so. We are suing the city. There is no way to get an injunction because without it going into effect there is no way to show damage that the Outlaw is going to suffer. We are looking into relocating the shop about 3 miles south in the city of Riverside. They are actually courting us because they want us to become the cornerstone for a new entertainment district. They are willing to do a lot of things that I can't talk about yet to get us into the city. The building would be free standing so we would not have to deal with any crap from anyone. Riverside will never pass a smoking ban(you have to be from the the area to really understand this)! We would be within 500 yards of the second largest casino in the area. For any of you that have been to the Outlaw, imagine the humidor about 5 times as large, The lounge about 4 times as big with fireplaces and a high end Scotch and Bourbon bar. A small kitchen with a limited day to day menu. A large outside patio with a large wood burning stove. A helicopter landing pad for our events! A few day apartments above the shop for VIPs and business travellers. This would be like nothing any of you have ever seen. The ultimate dream tobacco shop! Now, while we figure out what comes next we are going to deal with this just like we deal with everything. We are Outlaws, nobody tells us what we can do in our place but us! We will take our fines until it make since to have a temporary off-site smoking lounge(until we are up and running in the new shop). All of this is subject to change, we still may be able to get an exemption from the city if they find the lawsuit to be to much of a pain in the ass to deal with. ALL EVENTS WILL GO ON AS SCHEDULED!!!

Great work with the plans for the Outlaw! I am eager too see the unfolding of this story (I wish something like that happened in Health-Nut Australia).

We were just talking about this situation last night at the local herf, and although we figured a creative lot like yourselves would come up with a way around this mess you may have out done yourselves with these plans :) I will keep my fingers crossed, and hope it falls into place because that sounds like a heck of a dream shop. See you guys in a week.

Here in Taxachusetts, there is also a ban on smoking in any workplace. The sole EXCEPTION is that if a business derives 51% or more of its gross income from the sale of tobacco, smoking can be allowed. That law spurned the birth of a dozen or so "cigar bars" statewide. In those places, you must buy the cigars or cigarettes you wish to smoke right there, or pay a hefty ($10) "lighting" fee. The owners are (IMHO) justified in that policy, as they have to take pains to keep the ratio intact, and liquor ain't cheap.

The cigar shops who could afford to created smoking areas inside. The Owl Shop in downtown Worcester (Goerge Photokis, the owner is a gret guy and so was his son John) cleared out space in the front of the store and later, a whole upper floor of the building to create a private club for pipe & cigar aficionados. The membership is kind of steep, too much for me to join, but he has to recoup the loss of rental income from the business who had to move out.

Yesterday, the Mass House of Representatives voted in the affirmative to increase tax on a pack of cigarettes by another $1. I didn't see anything about cigars, pipe tobacco, snuff, chew or rolling tobacco. For me, there's "A Guy I Know" who's been going "out of state" for his weekly stock of cigars and his wife's cigarettes for some time now, and I think "he" will be seeing a lot more Mass-registered vehicles in the parking lot at Tobacco Haven.

As more B&Ms are forced into transitioning to membership based private cigar lounges, I predict we'll see more aggressive co-branding by manufacturer's to lend their name for sponsorships to the elite establishments.
 
Unfortunately I was right. I told OpusXKC this would pass without a problem. I've seen the drill before and the tobacco places held a special session with the Senate for the State and they even said no smoking in Tobacco shops for the city.

Again, this shit pieces me off to no end. I mean I joined the Military to PROTECT my rights and others, yet jack asses like these that pass a freaking law that prohibits me smoking in a place that is like my home. I better get off my soap box cuz now I am steaming pissed. I was dreading to see if it passed but already knew the answer. It makes me happy that I am in a country right now that you can smoke ANY where with only a couple of exceptions. But I can sit after a meal and fire up a Opus if I so choose and not a single soul will say jack shit to me. This will be a sad world if Russia gets on the no smoking bandwagon.
 
Every so often, a Brother will post of his layoff from his job. I usually post that this is Karma, kicking him on the street to find the job he was meant to go find. That would be the one more challenging and with better pay than the last one. KC gang, this just might be the way Karma spells it out to you that it's time for the new building, new practice and an even better customer base. Make something good of this.

I like the prospects of a new, larger Outlaw. Too bad that 52% of those that turned out for the election voted for this nanny-state crap. However, like has been mentioned before, this is potentially great opportunity and the city of Kansas City can "suck on the wet end" of that!

I love it when a plan comes together!

Feel free to light up at The Outlaw. This is Counsel I paid for and feel confident about. Thanks to a Missouri Statute we are not affected by the new smoking ordinance passed in Kansas City. Light’em up!"

Looks like we all get to keep on smokin' :cool:

Great news guys!!

Do you or Brad know why the Outlaw is being exempted or the statute that is cited? I know there is a proposed state smoking ban going through debate in the state senate, but it would specifically exempt cigar or tobacco shops.
 
Its not so much an exemption as a case of the state of Missouri defining tobacco shops as PRIVATE business.
It is clearly defined in the wording of the law passed by voters that smoking is banned in all PUBLIC places.
