wtf...age to buy cigars in florida?

this very very nice hotel down the street from my house sells montes, punchs, cohibas, and this other brand i cant remember the name of. i went there to get a few sticks of each brand but they wouldnt sell to me because they thought the legal age to buy cigars in florida is 21 (i'm 19). i told them that the gas stations have signs saying you have to be 18 to buy tobacco products so they called the manager and he confirmed that its 21 for cigars. ive been buying cheapo cigars (swishers, philly blunts, etc) since ive been 18 and have never had a problem. is there something in "real" cigars that raises the age to 21?

also, aren't cohibas cuban? how could this hotel be selling them?
 
I don't know what the laws are in Florida but that doesn't sound right.

As far as Cohibas, there are "Cohibas" that are made in the Dominican Republic. I highly doubt the hotel would be selling Havana made Cohibas out in the open.
 
Cohiba and many other ISOM companies have branched out to other countries for production so that they can get a piece of the massive American consumption. So I'd say that they're either selling Dominican Cohibas or fakes. Also, it sounds to me like the people running that place weren't too up on the law, I'd probably just not deal there.

Would you mind expounding on your statement above. I'm particularly interested in the source of this information on Cohiba and other isom companies branching out to other Countries for production.

Also, speaking towards the age requirements in Florida, just how does the law read?

569.101 Selling, delivering, bartering, furnishing, or giving tobacco products to persons under 18 years of age; criminal penalties; defense.--

(1) It is unlawful to sell, deliver, barter, furnish, or give, directly or indirectly, to any person who is under 18 years of age, any tobacco product.

(2) Any person who violates subsection (1) commits a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083. However, any person who violates subsection (1) for a second or subsequent time within 1 year of the first violation, commits a misdemeanor of the first degree, punishable as provided in s. 775.082 or s. 775.083.

(3) A person charged with a violation of subsection (1) has a complete defense if, at the time the tobacco product was sold, delivered, bartered, furnished, or given:

(a) The buyer or recipient falsely evidenced that she or he was 18 years of age or older;

(b) The appearance of the buyer or recipient was such that a prudent person would believe the buyer or recipient to be 18 years of age or older; and

© Such person carefully checked a driver's license or an identification card issued by this state or another state of the United States, a passport, or a United States armed services identification card presented by the buyer or recipient and acted in good faith and in reliance upon the representation and appearance of the buyer or recipient in the belief that the buyer or recipient was 18 years of age or older.

First off, thanks mhn for saving me the trouble. :) I was just meaning to point out how it would be absurd to have different age requirements to buy smokes from different places (i.e. cigar shops and supermarkets).

And what I was referring to with Cohiba is how General Cigar Holdings Incorporated (I think) makes Cohiba brand cigars in the Dominicans, and that and other like situations is why you can purchase Punch, Cohiba, Montecristo, RyJ, and such brand name cigars at your local smoke shop. I didn't mean to say that they all use the Dominicans, but was instead using Cohiba as a related example.
 
No, I'm saying they're employed by (or employing, I suppose) Cohiba to make "similar" cigars to appeal to the American public. I'm just trying to do my best to explain why this hotel was offering a cigar with a Cohiba band.
 
How exactly is an "American" company being employed by Cuban cigar factories? Isn't there an embargo? :lookup:
 
C'mon guys, quit letting the guy dig a deeper hole than he already has. He's just uninformed. General, Altadis, Consolidated, etc., etc., own the US rights to market all of the Cuban cigar brand names. They don't employ the Cubans to make their cigars for them. Each and every brand made in Cuba is owned by the government of Cuba and the Spanish leg of Altadis. But, you already know that. :)

I guess I may have not made myself unclear. I was referring to employing the services of, or by selling the rights to, I suppose. I didn't mean to say (even though it doesn't seem to me that I did) that Altadis and General Cigar boated Cubans over to do they're rolling and used their seed, but rather that said ISOM companies sold their rights for a marketshare, or to say that they gave the rights to produce their cigars for a share of the profits. Wouldn't that be to say that GC is running the factories/fields for Cohiba for a share (albeit large) of the profits?

Sorry I didn't quite express myself they way I intended, it made sense to me at the time. ???
 
So let me get this straight. An "American" company is in a "profit sharing" venture with the Cuban government. Am I understanding this correctly?

Sheesh, he is doing a fair job of trying to understand a very complicated situation. I will try to help out...

Situation 1: You know that Toyata is a Japanese Car Company, right? Well, there are certain Body type Toyotas that are made in the US rather than in Japan. The same is true for Nissan, Honda etc...

Situation 2: Well the Cigar Industry has manufacturing of the same name brands in Cuba as well as Dem. Rep.

Situation 1 and Situation 2 are not even close to the same thing. :lookup: :0

Thanks Jeff, I was wondering where I could get answers to my questions on the matter. As my last post shows, I am clueless ;)
